- Accurate Information: Customers must provide accurate and complete information about their bicycle and service needs.
- Ownership: Customers must be the legal owner of the bicycle or have authorization from the owner.
- Safety: Customers are responsible for ensuring their bicycle is safe to ride after service completion.
3. Service Terms
- Estimates: All service estimates are approximate and may change based on actual work required.
- Scheduling: Appointments are scheduled on a first-come, first-served basis. We reserve the right to reschedule due to unforeseen circumstances.
- Parts: Parts are included in service estimates unless otherwise specified. Additional parts may be required and will be charged separately.
- Turnaround Time: Service completion times are estimates and may vary based on complexity and parts availability.
4. Payment Terms
- Payment Methods: We accept cash, credit cards, and debit cards. Payment is due upon completion of services unless other arrangements are made.
- Prices: All prices are subject to change without notice. Quotes are valid for 30 days from the date of issuance.
- Taxes: All applicable taxes are additional to the quoted price.
- Hold Harmless: Higher Gear is not responsible for bicycles left unattended for more than 30 days after completion of services.
5. Warranty and Liability
- Limited Service Commitment: Most services include a 30-day service commitment on parts and labor from the date of service completion.
- Exclusions: Service commitment does not cover normal wear and tear, improper use, accidents, or modifications made by anyone other than Higher Gear.
- Liability: Higher Gear is not liable for any indirect, incidental, or consequential damages arising from service or use of repaired bicycles.
- Maximum Liability: Our total liability for any claim arising from services shall not exceed the amount paid for those services.
6. Website Use
- Website Access: We grant you a limited, non-exclusive, non-transferable access to use our website for personal, non-commercial purposes.
- Prohibited Activities: You agree not to: copy, modify, distribute, sell, or exploit any content from our website; attempt to gain unauthorized access to our systems; or interfere with website operation.
- Intellectual Property: All content on our website is owned by or authorized for use by Higher Gear and is protected by copyright and other intellectual property laws.
7. Dispute Resolution
All disputes arising from or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court. The arbitration shall be conducted in Cook County, Illinois.
8. Limitation of Claims
Any claim or cause of action arising out of or related to these Terms or your use of our services must be filed within one (1) year after the cause of action arose or be forever barred.
9. Indemnification
You agree to indemnify and hold harmless Higher Gear Bicycle Repair, its owners, employees, and affiliates from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the services, your violation of these Terms, or your violation of any rights of another.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of our services after any revision becomes effective constitutes your acceptance of the new Terms.
11. Termination
We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use our services will immediately cease.

- Entire Agreement: These Terms constitute the entire agreement between you and Higher Gear regarding the use of our services.
- Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
- Governing Law: These Terms shall be governed and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.
